1. Overview

These Terms of Service (“Terms”) govern your access to and use of our website, online store, products and related services (collectively, the “Services”).

Our online store is powered by Shopify, which provides the ecommerce platform that enables us to offer our products and Services to you.

Nothing in these Terms limits or excludes any rights you have under applicable consumer law.

When placing an order or creating an account, you agree to provide accurate, complete and up-to-date information, including your contact, billing and delivery information.

After receiving your order, we will normally send you an order confirmation by email.

A binding contract is formed once we accept your order and payment has been successfully authorised and processed.

We may refuse or cancel an order where reasonably necessary, including where:

  • a product is unavailable;

  • we identify a pricing or product information error;

  • we reasonably suspect fraud or misuse;

If we cancel an order after payment has been taken, we will refund the amount due to the original payment method.

5. Prices and Payment

Prices are displayed in the currency applicable to the market from which you are purchasing.

For customers in the United Kingdom, prices shown at checkout will include applicable taxes where required by law.

Any delivery charges or other mandatory charges payable by you will be clearly shown before you submit your order.

We will not add optional charges without your consent.

We may change our prices, discounts and promotions at any time, but changes will not affect orders that have already been accepted.

The price applicable to your purchase is the price displayed and confirmed when you place your order.

You agree to provide accurate and authorised payment information.

Payments may be processed by Shopify Payments and/or other third-party payment providers available through our checkout.

Promotions do not affect your statutory consumer rights.

7. Shipping and Delivery

Available delivery options and estimated delivery times will be displayed on our website or during checkout.

Where we advertise an estimated delivery period, for example 5–8 business days, this is an estimate rather than a guaranteed delivery date unless we expressly state otherwise.

We will take reasonable steps to deliver your order within the stated timeframe.

Unless a different timeframe has been agreed with you, goods will be delivered within any maximum period required by applicable consumer law.

Delivery may occasionally be affected by events outside our reasonable control, including carrier disruption, severe weather or customs processing.

Risk of Loss

Where UK consumer law applies, the goods remain at our risk until they are delivered into your physical possession or to a person identified by you to receive them.

If you independently arrange a carrier that was not offered by us, different rules may apply.

8. Cancellations, Returns and Refunds

Our voluntary policy provides free returns within 30 days of delivery, subject to the conditions set out in our Returns & Refund Policy.

This policy is in addition to, and does not replace, your statutory rights.

UK Right to Cancel

If you are a UK consumer purchasing online, you generally have the right to cancel your order without giving a reason within 14 days of receiving your goods.

After telling us that you wish to cancel, you generally have a further 14 days to return the goods.

For eligible returns, Balibou™ provides a prepaid return shipping label.

Nothing in these Terms limits your legal rights in relation to faulty, damaged, unsafe or misdescribed products.

9. Intellectual Property

The content made available through the Services, including our branding, logos, product names, text, graphics, images, videos, designs and website layout, is owned by Balibou™, our licensors or other relevant rights holders and is protected by applicable intellectual property laws.

You may access and use the Services for your personal, non-commercial use.

Unless permitted by law or authorised by us in writing, you must not reproduce, copy, modify, distribute, republish, sell or commercially exploit our content.

“Balibou™” and associated branding may not be used in a manner that falsely suggests sponsorship, affiliation or endorsement.

Third-party names, trademarks and logos remain the property of their respective owners.

However, purchases made through our store are transactions directly between you and Balibou™.

Shopify is not the seller of Balibou™ products and is not responsible for the performance of our obligations to you as the retailer.

Nothing in this section affects any rights or remedies you may have against Shopify under applicable law in circumstances where Shopify has independent legal responsibilities.

Our collection and use of personal information is governed by our Privacy Policy.

Because our store is powered by Shopify, Shopify also processes certain personal information relating to your access to and use of the Services.

If you voluntarily submit a review, photograph, comment, suggestion or other content to us, you confirm that:

Where permitted by law, we will not be liable for losses that were not reasonably foreseeable when the contract was entered into.

Nothing in these Terms is intended to restrict remedies available to consumers under applicable consumer protection law.

If you use the Services for commercial purposes or in breach of these Terms, you may be responsible for losses reasonably arising from your unlawful conduct or infringement of third-party rights, to the extent permitted by applicable law.

This section does not impose liability on a consumer where doing so would be unfair or unlawful.

These Terms are governed by the laws applicable to KERVENS ETIENNE in the jurisdiction where our business is established, subject to mandatory consumer protection laws that apply to you.

If you are a consumer in the United Kingdom, nothing in these Terms deprives you of any mandatory protections available to you under UK consumer law.

You may also have the right to bring proceedings in the courts available to you under applicable consumer law.

Changes will not retrospectively remove rights that have already arisen under an existing order.
